The general terms and conditions of sale of this online shop (hereafter referred to as ‘conditions’) govern the contracts for the purchase and sale of products (hereinafter referred to as ‘product(s)’) offered by the company Metal Lux S.N.C, Via Piave 35, 35017 Torreselle di Piombino Dese (PD), Italia, P.I. IT00410570287, through the site www.shop.metalluxlight.com to users of the site (hereinafter “customers / and” ) , in compliance with the regulations in force on electronic commerce and on contracts with distance.

All information contained on the site is in Italian and English. The customer declares to have read all the above information and general conditions of sale before placing the order.

The customer, before placing the order for the product, declares that the purchase of said product has no direct relationship with his professional activity, as the purchase is intended for personal use only.
The customer declares furthermore to have the legal capacity to undertake in accordance with the provisions of these general conditions.

1) Object

These general conditions of sale have as their object the definition of the rights and obligations of the parties in the context of a distance sale of goods offered in this online shop. These conditions of sale applied to orders are in force at the time of the order date.

2) Territory and coverage of the offer

This version of the general conditions of sale refers exclusively to sales made to consumers having their domicile or residence in Italy.

3) Prices

The prices displayed on the site are expressed in Euros and include VAT at 22% while shipping costs are excluded (See the “Shipping” section). The guaranteed price to the buyer is the one published on the site at the time of purchase and is to be considered final and cancels and replaces any previously published prices.

4) Receipt of the order

The images of the products are indicative and not binding and the products are not supplied as a trial.

Any order confirmation signed by the validation click constitutes an irrevocable commitment of the customer. Once confirmed, the order can only be canceled within 24 hours, after which the customer is obliged to pay. In compliance with the relevant laws, the customer can still withdraw from the contract within 14 days (see section Returns and Refunds)

5) Order confirmation

The contract is to be considered concluded only upon confirmation of the order by Metal Lux. The customer will receive by e-mail a notification of receipt showing the order confirmation with all the constituent elements of the contract (article code, prices, delivery dates, shipping costs).

Metal Lux reserves the right not to confirm an order for any reason relating in particular to a product supply problem or a problem concerning the order received.

6) Availability

The offers contained in this site will be valid as long as the products listed remain online and while stocks last.

Metal Lux reserves the right to communicate to the customer by email the possible unavailability of one or more of the products purchased In the event of the purchase of a product that is no longer available, Metal Lux shall refund (to the payment card or PayPal account indicated by the customer at the time of purchase or by bank transfer, the details of which shall be communicated after registration) the price and shipping costs incurred by the customer.

7) Payment

The customer who intends to proceed with the purchase of the products must express this desire through a request made directly on the site in the specifically dedicated section where, following the procedures indicated, he will send his purchase order and make the payment.
The payment of the consideration is due at the time of the order. The customer undertakes to pay the agreed price for the product ordered on the site (price of the products and transport) using the available payment methods (See the “Payment Methods” section).
In case of non-receipt by Metal Lux of payment, Metal Lux reserves the right to cancel the order. In the case of payment by credit card, Metal Lux reserves the right to request the sending, within 24 hours, of a copy of an identity document proving the actual ownership of the credit card used, it being understood that, in the absence of the requested submission, Metal Lux may refuse the payment and cancel the order. If the payment is made by bank transfer, in case of non-receipt by Metal Lux of the transfer within 7 days following the confirmation of the order, Metal Lux reserves the right to cancel the order. The bank details are available in the “Payment Methods” section.

8) Retention of title

The ordered products remain the property of Metal Lux until the final and full payment of their price (pursuant to Art. 1523 and following of the Italian Civil Code). Metal Lux reserves the right to claim the ordered products in case of non-payment.

9) Delivery

The products are delivered to the address indicated by the customer.

The shipments will take place after receiving confirmation of payments: for the bank transfer the crediting to our current account is valid, while for the payment by credit card the confirmation of the transaction by the circuit is valid.

Delivery is to the street level unless otherwise indicated. The request for delivery to the floor of an order must be indicated by the customer at the time of the final confirmation of the order. Metal Lux does not provide for the installation service of the products sold. Metal Lux cannot be held liable for delivery errors due to inaccuracies or incompleteness in the customer’s completion of the purchase order. Furthermore, Metal Lux shall not be liable for any damage that may occur to the products after delivery to the carrier in charge of their transport as well as for delays in delivery attributable to the latter.

Shipments normally take place when all the goods are ready, but if you have different needs, you can contact customer service by e-mail to ensure maximum support. If there are items with different delivery times in the order, the customer may indicate in the notes when checking out any particular urgency as the delivery time is determined by the product with the longer lead time.

Products are shipped by express courier within 15 working days. In the case of large orders and / or particularly delicate products, the shipment is made by specialized couriers with delivery times varying in relation to the volume and destination of the goods. The delivery document issued by the carrier, dated and signed by the customer upon delivery of the product, shall constitute proof of transport and release of the goods.
Upon delivery, the customer shall check the content, conformity and condition of the products.
In the event of delays, breakdowns, total or partial loss or other problems, the customer has recourse to the carrier without Metal Lux ever being held liable.
Therefore, upon delivery, Metal Lux recommends the customer to check the condition of the delivered products before signing the receipt.

Any delays in delivery of less than 30 (thirty) days shall not entitle the customer to refuse delivery of the products, nor to claim compensation or indemnity of any kind.
Metal Lux has the right, should it deem it appropriate, to request the delivery of products (also relating to the same order) in several stages. Delivery is deemed to have been made from the moment the product is handed over to the customer.

10) Failed delivery

In case of absence of the recipient during the delivery, the carrier will leave a notice of passage to the delivery address indicated by the customer. The products must be collected at the address and in the manner indicated by the carrier.

In case of failure to collect within the deadline set by the carrier, the products will be returned to Metal Lux, which reserves the right to reimburse the price of the products, excluding any shipping costs that remain charged to the customer.

In the event of an error regarding the product, the customer undertakes to return said product or products concerned to Metal Lux within 7 (seven) days of receipt, with the closed package, in their original state and packaging and with the documents delivery.
Once the product has been received in the correct form and manner, Metal Lux will return, at its own expense, the product initially ordered.

11) Withdrawal, Returns and Refunds

The customer has the right to withdraw from the contract, without stating reasons, within 14 days after delivery of the order. The withdrawal period expires after 14 days from the day on which the customer, or a third party indicated by him, acquires physical possession of the goods received.

In order to exercise the right of withdrawal, the customer must communicate his or her decision to withdraw from this contract by means of an explicit declaration, no later than the deadline indicated above, by sending an e-mail to the following address@info@metalluxlight.com

The address for the return shipment is indicated in the appropriate section and must be made within 14 days from the date the withdrawal from the contract was communicated. The direct costs of returning goods will be borne by the customer. For the purposes of the time limit, the product is deemed to have been returned at the moment it is handed over to the post office and/or accepting carrier.

The customer shall be liable for any diminution in the value of the goods resulting from any handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods. The returned goods must be returned in resalable condition.
Please note, in the event of non-saleability the amount equivalent to the decrease in asset value may always be retained.

The cost of returning the goods shall be borne by the customer. If the customer exercises the right of withdrawal in accordance with the provisions of these Terms and Conditions of Sale, Metal Lux will refund the sums paid by the customer to the same means of payment used by the customer for the original transaction (credit card, paypal, bank transfer), unless otherwise indicated by the customer.

The refund will be made, free of charge, within a period of 14 days after Metal Lux became aware of the customer’s exercise of the right of withdrawal.

10) Force majeure

The following cases, in addition to those normally considered by case law, are also considered as cases of force majeure:
– total or partial strikes, internal or external to the company, blockage of means of transport or supply for any reason, governmental or legal restrictions, computer breakdowns, blockage of telecommunications including networks and in particular the internet.
In the event of force majeure, the execution of the order will initially be suspended.
If a period of three (3) months has elapsed and the parties find that the force majeure case persists, the order shall be automatically cancelled, unless otherwise agreed by both parties.

11) Warranty

All products undergo quality control procedures before being shipped. However, in the event of any inconvenience, the customer benefits from Metal Lux’s legal guarantee for the duration of 24 months or 48 months for certain articles as stated in the product section provided that he has normal use and in accordance with the recommendations in the documents accompanying the products and their instruction manuals.

Without prejudice to the hypotheses of Metal Lux’s willful misconduct or gross negligence, it is hereby agreed that if Metal Lux is found to be responsible for any reason whatsoever towards the customer – including the case of total or partial non-fulfilment of Metal Lux’s obligations towards the customer as a result of the execution of an order – Metal Lux’s responsibility will not exceed the price of the products purchased by the customer and for which the dispute arose.

Metal Lux does not give any guarantee as to the compatibility of the products with other products or equipment used by the customer, nor does it give any guarantee as to the suitability of the products for the specific use intended by the customer.

12) Personal data

Metal Lux is the owner of the personal data collected at the time of registration on the site, as well as those subsequently communicated at the time of purchase by the customer, excluding data relating to the payment procedure for which reference is made to the banking institutions through which the transaction takes place. For information on the processing of personal data, including the rights under Art. 7 del D. lgs. 196/03, please refer to the detailed information provided in the relevant section.

13) Electronic signature

The ‘validation click’ constitutes an electronic signature and has, between the parties, the same value as a handwritten signature.

14) Contractual integrity

These general terms and conditions constitute the entire obligations of the parties.
No other general or particular conditions communicated by the customer may be included in or deviate from these general conditions.

15) Nullity

Should one or more provisions of these general terms and conditions be deemed invalid or declared invalid by application of a law, regulation or following a final decision by a competent jurisdiction, the other provisions shall retain all their force and effect.
